Terms of Service

1. Agreement to Terms
By using Locu Labs s.r.o. ("Locu", "we", "us", or "our") desktop application and services available at locu.app (collectively, the "Service"), you agree to these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
2. Changes to Terms
We may modify these Terms at any time. We'll notify you of material changes 30 days before they become effective. Continued use of the Service after changes constitutes acceptance of the modified Terms.
3. Privacy Policy
Our Privacy Policy at locu.app/privacy explains how we collect and use your information.
4. Account Requirements and Security
To use our Service, you must be at least 16 years old and provide a valid email address. You are responsible for maintaining the security of your account and password. We cannot and will not be liable for any loss or damage from your failure to maintain account security. You are responsible for all activity that occurs under your account. Accounts must be registered by individuals and cannot be shared between multiple users.
5. Your Content and Rights
You retain ownership of any content you create or upload to the Service. By using our Service, you grant us the necessary rights to host, store, and display your content solely for the purpose of providing and improving the Service. You are responsible for ensuring you have all necessary rights to share any content you post. We reserve the right to remove any content that violates these Terms or applicable laws.
6. Acceptable Use
You agree to use the Service in compliance with all applicable laws and regulations. You may not use the Service to harass, abuse, or harm others, or to post illegal or harmful content. You agree not to interfere with the Service's operation, attempt to access restricted areas, or reverse engineer the Service. We reserve the right to suspend or terminate accounts that violate these terms.
7. Payment and Subscription
Our payment terms are specified at checkout. All payments are non-refundable unless required by law. We may change our prices with 30 days advance notice to you. Failure to pay may result in service suspension or termination. You are responsible for all applicable taxes and third-party charges.
8. Termination
You may terminate your account at any time through the Service interface. We may terminate or suspend your access to the Service immediately if you violate these Terms. Upon termination, you will lose access to the Service and your content. We may retain your data as required by law or as necessary to protect our legal interests. Locu has the right to suspend or terminate your access to all or any part of the Website and Service at any time, with or without cause, with or without notice, effective immediately. Locu reserves the right to refuse service to anyone for any reason at any time. Before account termination, you may export your data through the available export tools in the Service. After termination, access to data export tools will no longer be available.
9. Service Availability and Warranties
The Service is provided "as is" without any warranties, express or implied. We do not guarantee that the Service will be uninterrupted, timely, secure, or error-free. We may offer beta features which are provided without warranty and may be changed or discontinued at any time.
10. Data Backup
While we implement reasonable data backup procedures, you are responsible for maintaining your own backups of any data you upload to the Service.
11. Beta Services
Occasionally, we look for beta testers to help us test our new features. These features will be identified as “beta” or “pre-release,” or words or phrases with similar meanings (each, a “Beta Services”). Beta Services may not be ready for prime time so they are made available “as is,” and any warranties or contractual commitments we make for other Services do not apply. Should you encounter any faults with our Beta Services, we would love to hear about them; our primary reason for running any beta programs is to fix issues before making a new feature widely available.
LOCU WILL HAVE NO LIABILITY ARISING OUT OF OR IN CONNECTION WITH ALPHA AND BETA SERVICES - PLEASE USE AT YOUR OWN RISK.
12. Limitation of Liability
Our liability is limited to the maximum extent permitted by law. We are not liable for data loss, service interruptions, or any indirect, consequential, or incidental damages. Our total liability for any claims under these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.
13. Communication
We primarily communicate via email. Legal notices must be sent in writing to our registered address. For support inquiries, contact support@locu.app. We do not provide telephone support.
14. Survival
Provisions regarding content rights, payment obligations, liability limitations, and confidentiality survive any termination of these Terms.
15. Governing Law
These Terms are governed by and construed in accordance with the laws of Slovakia. Any disputes arising from these Terms or the use of the Product shall be resolved exclusively in the courts of Slovakia.
